THE AMENDMENT OF THE STRUCTURE, COMPOSITION, ROLE AND RESPONSIBILITY OF THE COUNCIL FOR AGRICULTURAL AND RURAL DEVELOPMENT

THE ROYAL GOVERNMENT OF CAMBODIA
 

- Seen the Constitution of the Kingdom of Cambodia
- Seen the Royal Decree No. NS/RKT/1198/72 dated 30 November 1998 on the establishment of the Royal Government of Cambodia
- Seen the Royal Law No. 02/NS/94 dated 20 July 1994 on the organization and functioning of the Office of Prime Minister
- Seen the Sub-Decree No. 56 ANK-BK dated 11 July 1995 on the establishment of the Council for Agricultural and Rural Development
- Pursuant to the vital needs
 
HEREBY DECIDED

CHAPTER I
STRUCTURE AND COMPOSITION OF
THE COUNCIL FOR AGRICULTURAL AND RURAL DEVELOPMENT "CARD"
 
Article 1: The composition of the Council for Agricultural and Rural Development (CARD) was amended as follows:

- Prime Minister..............................................................................................Chairman

- Minister or representative of the Office of Prime Minister.......................................Member
- Minister or representative of the Ministry of Interior.............................................Member
- Minister or representative of the Ministry of Economy and Finance..........................Member

- Minister or representative of the Ministry of Agriculture,
Forestry and Fishery.........................................................................................Member

- Minister or representative of the Ministry of Water Resources
and Meteorology..............................................................................................Member

- Minister or representative of the Ministry of Environment.......................................Member
- Minister or representative of the Ministry of Commerce.........................................Member
- Minister or representative of the Ministry of Planning............................................Member
- Minister or representative of the Ministry of Public Work and Transport....................Member
- The Governor General of the National Bank or representative.................................Member

Article 2: Established the General Secretariat of CARD directly administrated by a Secretary General and assisted by a number of Deputy Secretaries General if necessary.

The General Secretariat of CARD consists of 6 specialized sections, namely:
- Administration Section
- Agricultural Section: animal production, materials, mechanization, human resources, etc.
- Rubber Section
- Rural Development Section
- Forestry and Fishery Section
- Water Resources (Irrigation)
Article 3: The Secretary General ranks at the level of Secretary of State. The Deputy Secretary General ranks at the level of Under Secretary of State. Each Section ranks at the level of Department and is headed by a Director.
 
Article 4: The Council for Agricultural and Rural Development consists of an Executive Committee for managing its affairs on a daily basis.
 
The CARD Executive Committee is composed as follows:
1. Chairman of CARD
2. Vice-Chairman of CARD
3. Secretary General of CARD
4. Deputy Secretaries General of CARD

 
Article 3: The Secretary General ranks at the level of Secretary of State. The Deputy Secretary General ranks at the level of Under Secretary of State. Each Section ranks at the level of Department and is headed by a Director
 

Article 4: The Council for Agricultural and Rural Development consists of an Executive Committee for managing its affairs on a daily basis.

The CARD Executive Committee is composed as follows:

1. Chairman of CARD
2. Vice-Chairman of CARD
3. Secretary General of CARD
4. Deputy Secretaries General of CARD

 
CHAPTER II
ROLES AND RESPONSIBILITIES OF CARD
 
Article 5: The Council for Agricultural and Rural Development (CARD) fulfills a role as a particular assistant to the Government in the fields of Agricultural and Rural Development with the close cooperation with concerned and competent ministries-institutions, particularly the Council for the Development of Cambodia (CDC), the Ministry of Agriculture, Forestry and Fishery (MAFF), the Ministry of Rural Development (MRD), the Ministry of Public Works and Transport (MPWT) and the Ministry of Water Resources and Meteorology (MWRM) to enhance smooth and efficient implementation of integrated programs/projects and to have a right to decide on means, materials, funds and other activities to achieve the duties which will be described in Article 6.

Article 6: The Council for Agricultural and Rural Development has the following duties:
- Follow up and give opinions on the implementation of Government platform and National Program
for Rehabilitation and Development of Cambodia towards Agricultural and Rural Development
aiming at transforming the traditional subsistence agriculture into the export production to overseas
and reducing step by step the disparity between the rural and the urban people.
- Identify the key factors to be used in the Agricultural and Rural Development.
- Identify the priority and policy of Agricultural and Rural Development in conformity with the Royal
Government policy.
- Motivate and coordinate the participation of the population, especially the private companies, rural
communities, IOs, NGOs, various ministries and provincial authorities to facilitate and better
collaborate in Agricultural and Rural Development to ensure the sustainable production and
exploitation and to ensure the food security for alleviating the poverty in rural areas.
- Inspect, give opinions and resolve all proposals raised by various ministries-institutions concerning
the Agricultural and Rural Development. Report to and ask opinions from the Government on the
main issues which are under the competency of the Government.

 
CHAPTER III
THE FUNCTIONING OF CARD
 
Article 7: The Chairman of CARD has the following roles and responsibilities:
- Be responsible for the overall work of CARD;
- Act as Chairperson of the CARD and CARD Executive Committee meetings;
- Lead the discussion and summarize the decisions made during the course of CARD and CARD
Executive Committee meetings;
- Call for ordinary meetings or in the vital needs, special meetings of CARD and CARD Executive
Committee.

Article 8: The Vice-Chairman of CARD has the following roles and responsibilities:
- Be responsible for the overall work of CARD during the absence of the CARD Chairman;
- Manage CARD affairs on a daily basis;
- Act as member of the chairing board of the CARD and CARD Executive Committee meetings and
sign the minutes and information letters of the meeting of CARD;
- Coordinate between CARD and the Government ministries-institutions;
- Relate with International agencies concerning in Agricultural and Rural Development.

Article 9: The Secretary General has the following roles and responsibilities:
- Manage all affairs of the CARD Secretariat;
- Prepare the CARD program and the agenda and other documents for CARD & CARD Executive
Committee meetings;
- Prepare and issue the minutes and information letters of the CARD & CARD Executive Committee
meetings to submit for signature of the CARD Vice-Chairman;
- Prepare the quarterly, semiannually and annually reports of CARD;
- Prepare the press release for CARD;
- Attend the CARD & CARD Executive Committee meetings;
- Fulfill other activities delegated by the Chairman & Vice-Chairman of CARD.

Article 10: Each Deputy Secretary General fulfills duties delegated by the Secretary General.
Article 11: The members of CARD have the following roles and responsibilities:
- Attend the ordinary and special meetings of CARD to discuss and decide on the proposals raised by
concerned institutions related to Agricultural and Rural Development;
- Members being the head of institution shall be responsible for raising the policies, reports, measures,
other proposals, etc., to CARD for inspecting and taking decision;
- Inspect and decide on quarterly, semiannually and annually reports of CARD.
Article 12: The CARD must call an ordinary meeting every three months.
Article 13: The CARD Executive Committee must call an ordinary meeting every two weeks.
Article 14: The CARD has the right to invite the Heads or representatives of institutions or advisers if
necessary, to attend the meetings of CARD or CARD Executive Committee.
Article 15: The CARD Vice-Chairman and Secretary General have the right to attend the plenary session of the Council of Ministers upon the invitation of the Office of Prime Minister.
Article 16: The Office of Prime Minister is in charge of all expenditures of CARD related to its administrative costs and its staff salary.
Article 17: In the vital needs, the CARD is able to call special meetings of CARD and CARD Executive Committee.
Article 18: The functioning of the CARD and CARD Executive Committee, the organization and functioning of the CARD General Secretariat shall be determined in the CARD internal regulations.

 

CHAPTER IV
FINAL DISPOSITION
 
Article 19: The CARD utilizes the stamp of the Office of Prime Minister.
Article 20: Any former Sub-Decrees and Decisions contrast to this Sub-Decree shall be abrogated.
Article 21: The CARD, all relevant ministries and institutions, and all concerned personalities shall implement this Sub-Decree from the date of its signature.
