ANUKRET
on the Amendment to Anukret No. 78/ANK/BK of December 01, 1997 on
the Organization and Functioning of the Ministry of Rural Development
 
THE ROYAL GOVERNMENT OF CAMBODIA
 
- HavingSeen the Constitution of the Kingdom of Cambodia
- Seen Reach Kram No. 02 NS/94 of July 20, 1994, promulgating the law on the organization and functioning of the Council of Ministers
- Having seen Reach Kret No. NS/RKT/1198/72 of November 30, 1998 regarding the establishment of the Royal Government of Cambodia
- Having seen Royal Kram No. NS/RKT/0196/12 of January 24, 1996, promulgating the Law on the Creation of Ministry of Rural Development
- Having seen Anukret 20/ANK/BK of April 30, 1996 on the Organization and Functioning of the Ministries and State Secretariats;
- Having seen Anukret No. 78/ANK/BK of December 01, 1997 on the Organization and Functioning of the Ministry of Rural Development;
- Pursuant to the proposal of the Senior Minister and Minister of Rural Development
 
DECIDES
 
Sole Article:
Articles 3, 6, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23 and 24 of Chapters 2, 4, 5, 6, 7, 8 and 9 of Anukret No. 78/ANK/BK of December 01, 1997 on the Organization and Functioning of the Ministry of rural Development amended and modified as follows:
 
CHAPTER I
Mission and Structure
 

Article 3 (new): The Ministry of Rural Development shall have the following roles and duties to:

- Determine policies and strategies for rural development in compliance with the Royal Government's programs and policies;
- Propose short-term, medium and long-term plans for rural development to improve economic, social and cultureal status of the rural people, including the the ethnic minority within the Kingdom of Cambodia and gradually redue of poverty and gap between the rural and town people;
- Participate in the restoration and development fo the country in the scope of rural development by limiting its activities to families, villages and communes of the Kingdom of Cambodia;
- To study, research, collect and supervise data, information and statistics on economic, social and cultural status at the rural areas of the Kingdom of Cambodia, including the mountainous, plain and delta zones.
- Human resource development by means of technical skill and knowledge training for officials and civil servants;
- Organize regional technical skill and professional training center to meet the need of rural people and due to is available resources;
- Educate and disseminate to promote the productivity and family income generation based on the research on rural development technical skills;
- Liaison, coordinate and cooperate with the foreign entity, international organization, non-governmental organization, state institutions and authority of all levels and relevant private sectors and local people for sustainable rural development
- Supervise, administer and in charge of implementation of rural developmen water supply, primary health care, community development and rural economic development in cooperation relevant institutions; and
- Promote organization and strengthening all levels of rural development structures, in particularly, local committee for rural development

 
CHAPTER II
General Department of Administration and Finance
 

Article 6 (new):

A general department of administration and finance is in charge of liaison, coordination and supervision of administration work, staff, materials, equipment, accounting, finance, planning, statistics, monitoring, and evaluation, national and international cooperation and training, research and dissemination. A general department shall be headed by one president and assisted by a number of vice-general directors if necessary. This general department shall consist of five departments as follows:

- Department of administration and personnel;
- Department of supply and finance;
- Department of planning and public relations;
- Department of training and research; and
- Department for ethnic minority development.

Article 11 (new):

Department for ethnic minority development is in charge of:

- Proposing short-term, medium and long-term plans for development of ethnic minority community;
- Study and research about ethnic minority living in the mountainous, plain and delta zones specify the exiting identity, forest, culture and customs of each community within the Kingdom of Cambodia
- Preparing, planing and implement programs and ethnic minority development project at the mountainous, plain and delta zones under the specified priority;
- Coordinating all development of ethnic minority living at the mountainous, plain and delta zones within the Kingdom of Cambodia
- Monitoring, evaluation and reporting of all implementation of ethnic monitoring development programs and projects
- Training of civil servants of all levels and organize seminar to encourage the active participation of ethnic minority development process at the mountainous, plain and delta zones
- Creating and management of national information center for development of the mountainous and plain zones by cooperation with relevant institutions, international organizations, non-governmental organizations and neighboring countries having the same mountainous and plain development programs;
- Preparing and improving policies for development of at the mountainous and plain people and submit to the Royal Government for review and approval; and
- Designing the guidelines and criteria for the creation of ethnic minority community at the mountainous, plain and delta zones.

Article 12 (new):

The general department is in charge of liaison, coordination and supervision over rural road, water supply, primary health care and rural economic development. This department shall be headed by one general director and assisted by a number of vice-general directors as assistants if necessary. The general department compuoses of 5 departments as follows:

- Department of rural water supply;
- Department of rural health care;
- Department of community development;
- Department of rual economic development; and
- Department of rural road.

New Article 13 (previously article 12):

Department of rural water supply is in charge of:

- Preparing and proposing plan for restoration and development of small (family, vilage and commune) irrigation system and small power system and safe water supply system for short-term, medium and long-term utilization;
- Study, research, proposing plan for reparis, construction and maintenance of small water supply system for short-term, medium and long-term utilization in cooperation with the relevant authority;
- Inspection of the quality of well water before offering to the local people; and
- Preparing formality related to citizen's operation and maintenance of safe water, consumption water and irrigation water and organization of association or group of rural water consumers.

New Article 14 (previously article 13):

Department of rural health care is in charge of:

- Preparing and proposing plan for short-term, medium and long-term primary health care at the rural areas;
- Training of rural development civil servants and village volunteer health care agents the knowledge and skill on primary health care and hygiene;
- Education on primary health care to the community, including nutrition, women health care, evolution of children, mental health care and prevention against illnesses; and
- Organizing village hygiene and environment by supporting and encourage construction of family and public toilets and educate the villagers to clean their residences and use safe water.

New Article 15 (previously article 14):

Department of community development is in charge of:

- Preparing and proposing plan for short-term, meduim and long-term community development;
- Study and proposing plan for repairs and construction of rural infrastructures, including school, developing village, health care center etc. under the specified plans by cooperation with the relevant institutions;
- Building and managing the community development center
- Encourageing the people to increase food products for family support and markets;
- sending community development agens to rural areas for litercy program, environmental and natureal resource protection and encouragement for reforestation, preservation of tradition, culture and livelihood morality, citizen rights, democracy, appropriate technology for production, mine protection etc.;
- Using its effort to provide support/solution for dispalced persons; and
- Designing formality for creation, extension and strenthening of rural development structure, in particulary, village/commune development committee.

New Article 16 (previously Article 15):

Depatment of rural economic development is in charge of:

- Preparing and proposing plan for short-term, medium and long-term rural economic development;
- Desinging policies and encourage the people to participate in the establishment of village bank, rice bank, animal bank, agricultural equipment bank;
- Prearing formality relating to loan for people and formation of credit associations;
- Encouragement of rural people to save money through dissemination, group building/saving committee and instruction of measures for protection of saving fund;
- Supervise, instruct about the preparation of accounting for rural credit operations;
- Encouragement and promotion of people, association or private sectors to establish small rural enterprises and handicrafts; and
- Study and seeking for markets for circulation of products for reasonable price for the prupose of promoting livelihood of rural farmers and handicrafts.

New Article 17 (additional provision):

Department of rural road is in charge of:

- Preparing and proposing plan for restoration and development of short-term, medium and long-term rural roads;
- Study, research, proposing plan for reparis, construction and maintenance or rural roads;
- Management of all rural roads with less than 50 vehicles trafficking per day;
- Implementation and analyze the calculation of vehicle traffic and inventory book of rural roads;
- Organization and improvement of rural road policies to meet with:

  - Technology choices;
- Specification and size;
- Rules and formality of contract;
- Environment and safety standard;
- Men/Women's role, social vulnerability and labor standard;
- Preparing formality related to rural road operation and maintenance by the rural people themselves to ensure sustainable rural development; and
- Training of civil servants in charge of performance and inspection of the implementation of rural road programs and projects.
 
CHAPTER VI
The Minister's Cabinet
 

New Article 18 (previously Article 16):

The Minister's cabinet is in charge of missions determined by the Sub-decree No. 20/ANK/BK of April 30, 1996 as referred to in the above preamble regarding the organization and functioning of the ministries and state secretariates.
 
CHAPTER VII
Local-based entities
 

New Article 19 (previously Article 17):

There shall be provincial/municipal rural development department at each province/municipality that implements and coordinate the Ministry of Rural Development's activities.

 
CHAPTER IIX
Auditing Entity
 

New Article 20 (previously Article 18):

An auditing entity shall be created by the Minister of Economy and Finance under the conditions of regulation specified in Sub-decree No. 81 of November 16, 1995 on the establishment of financial institution for controlling ministerial expenses.

 
CHAPTER IX
Financial Provision
 

New Article 21 (previously Article 19):

The organization and functioning of ministerial central administration of from department or lower institution shall be determined by Prakas of the Ministry of Rural Development

 
CHAPTER IIX
Auditing Entity
 

New Article 22 (previously Article 20):

The duties relevant to other institution's competency, the cheif of such institution and the Minister of Rural Development shall cooperate to allocate the responsibilities and perform such activities through a joint Prakas of the Minster of Rural Development and chief of such instituion.

New Article 23 (previously Aticle 21):

Any provisions which are contrary to this Anukret shall be null and void.

New Article 24 (previously article 23):

The Minister in charge of the Council of Ministers, Minister of Rural Development, the Ministers and Secretaries of State of all relevant institutions shall effectively implement this Anukret from the date of signature herein.
